Brief Overview of Distribution Charges in Salt Lake City, UT

According to §58-37-8 of the Utah Controlled Substances Act, it is considered to be an illegal offense to either distribute a controlled substance or to even just agree to distribute. The penalties associated with a drug crime of this nature are completely dependent on several factors - such as the type of drug that is included in the offense, the amount of the drug and the area in which the distribution is occurring. For example, being caught distributing drugs in the vicinity of a schoolyard will carry heavier penalties than being caught near a bar.

What exactly is considered to be a controlled substance to the state of Utah? The Utah Controlled Substances Act clearly states in §58-37-2 that a controlled substance is either one that is legally defined in Section 58-37-4 or one that the federal government outlines in their own Controlled Substances Act; it, however, does not include alcoholic beverages, any drug that is being used for medicinal purposes or a drug that is being used as a dietary supplement.

What is considered to be a controlled substance?

Federal law is very clear in defining what is considered to be a controlled substance. In an effort to organize these substances, the state uses schedules to help split and categorize - drugs are considered to fall into Schedule I, II, III, IV or V. A Sc hedule V drug is considered to be one that has a very low potential for abuse and could even have an accepted medical use within the United States. Some examples of a Schedule IV drug include cough suppressants with limited codeine.

Each subsequent schedule will increase in severity. For example, a Schedule IV drug is considered to still have a low potential for abuse, but is considered to be more open to abuse than a Schedule V; examples include benzodiazepines, such as Xanax and Valium. This will increase until the drug is placed within Schedule I. These drugs have a high potential for abuse, no accepted medical treatment and there is not considered to be a safe way to use these drugs ; an example of this includes heroin.
