When is a DUI considered to be a felony?

In the state of Utah, a DUI conviction can be achieved one of two ways. You can either be proved to have blood alcohol content (BAC) over the legal limit, which is 0.08 percent in most cases, or you could be proven to be under the influence of drugs, alcohol or both. In many cases this is considered to be a class B misdemeanor, although there are some factors which can elevate the charge to a class A misdemeanor. In some cases, a DUI can be classified as a third-degree felony. Factors that can cause this to happen include an accident occurring during the commission of the DUI that caused serious bodily injury to a victim, the defendant being previously convicted of automobile homicide or having a defendant that has a felony DUI on their criminal record prior to this arrest. In some cases, a DUI could even be classified as a third-degree felony should they have multiple DUI on their record - specifically, two prior convictions within the last decade. This could mean anything from a DUI to alcohol-related reckless driving.
